General Terms and Conditions (GTC) – Taxi-Rent.ch

1. Scope
These General Terms and Conditions (GTC) apply to all rental agreements between Executive Limousine GmbH (hereinafter referred to as the "Lessor") and the renter (hereinafter referred to as the "Customer") concluded via the website www.taxi-rent.ch or by other means. Taxi-Rent.ch is a brand of Executive Limousine GmbH, located at Riedenerstrasse 89, 8304 Wallisellen, Zurich, Switzerland. All services are legally provided by Executive Limousine GmbH.
2. Conclusion of Contract
2.1. A rental contract is concluded once the Customer receives written confirmation from the Lessor following a reservation request.
2.2. The Customer must reside in Switzerland and hold a valid driver’s license.
2.3. The name on the reservation must match the driver named in the rental contract. A valid ID and driving license must be presented at pickup.
2.4. Only the person named in the rental contract is authorized to drive the vehicle.
2.5. Executive Limousine GmbH reserves the right to decline reservation requests without providing reasons.
3. Reservation Prepayment
3.1. A non-refundable prepayment of CHF 100 is required for all new reservations.
3.2. This amount is credited toward the total rental price.
3.3. If the Customer cancels the reservation or does not show up, this CHF 100 fee is retained in full.
4. Rental Period and Return
4.1. The vehicle is rented for the agreed period only. Any extension requires prior written approval from the Lessor.
4.2. Vehicles must be returned clean and with similar fuel or battery charge level as at pickup.
4.3. If the vehicle is returned more than 30 minutes late, a full additional rental day will be charged for every 24-hour period started.
4.4. A cleaning fee of up to CHF 300 may apply in case of excessive dirt or interior mess.
5. Rental Price, Deposit, and Payment
5.1. The weekly rental includes 2,000 km. Extra kilometers are charged at CHF 0.50/km unless unlimited mileage is specifically agreed.
5.2. A refundable deposit of CHF 500 is required prior to pickup.
5.3. This deposit is refunded within 10 business days after return, provided there is no damage or outstanding balance.
5.4. The deposit is only withheld in case of minor damage such as scratched rims, light body scratches, or other small external defects.
5.5. Payment is arranged individually with the Customer (e.g., cash or bank transfer). Payments are not processed through the website.
6. Use of the Vehicle
6.1. Vehicles are intended solely for ridesharing (Uber, Bolt, licensed taxi use) and must be operated in accordance with Swiss law.
6.2. Driving outside of Switzerland is only permitted with prior written approval from the Lessor.
6.3. Smoking is strictly prohibited in the vehicle. A cleaning fee will apply in case of violation.
7. Liability and Insurance
7.1. Vehicles are insured for liability coverage.
7.2. In case of an accident, the driver is fully liable for all damages regardless of insurance coverage, unless otherwise agreed in writing.
7.3. Damage to the interior or excessive wear may result in additional charges of up to CHF 1,000.
7.4. If a vehicle is impounded, the Customer is responsible for related fees, including up to CHF 100 per day in parking costs.
8. Cancellations and Refunds
8.1. The only cancellation fee is the CHF 100 prepayment, which is non-refundable.
8.2. No further cancellation fees are applied.
8.3. If a Customer returns the vehicle earlier than agreed (e.g., after 3 weeks of a 1-month rental), no refund will be issued for the unused days.
8.4. Cancellations must be made in writing.
9. Accidents and Incidents
9.1. Any accident, theft, or significant damage must be reported immediately to both the police and the Lessor.
9.2. The Customer must submit a written report and, if applicable, a police report.
9.3. The Customer bears all costs not covered by insurance, including those arising from theft, negligence, or vehicle impoundment.
10. Data Protection
10.1. Executive Limousine GmbH handles personal data according to its privacy policy.
10.2. Personal data will not be disclosed to third parties unless required by law.
11. Governing Law and Jurisdiction
11.1. These terms are governed by Swiss law.
11.2. Place of jurisdiction is Zurich, Switzerland.
12. Final Provisions
12.1. Any changes to these terms must be made in writing.
12.2. If any provision is found to be invalid, the remaining provisions remain unaffected.
